1. Licensor and application

This agreement applies to the PL8 app, bundle and Android package identifier \me.offlocalhost.pl8\, including components and store updates supplied by Burlis unless a later component has separate terms. PL8 is licensed, not sold.

The Terms of Service govern the optional Friends service. The Privacy Policy explains data processing. Consent is requested separately where required.

2. Licence grant

Subject to this agreement, Burlis grants you a limited, personal, non-exclusive, non-transferable and non-sublicensable licence to install and use PL8 for lawful personal purposes on devices you own or control and through a store account you are authorised to use.

On Apple devices, the licence is limited to Apple-branded products you own or control as permitted by the Apple Media Services Terms and Usage Rules, including use by accounts associated through Family Sharing or volume purchasing where those rules allow it. On Android devices, use must comply with the applicable Google Play and device terms.

You may retain copies created by an authorised store, operating-system process or user-initiated PL8 export to the extent permitted by law and this agreement.

3. Restrictions and lawful exceptions

Unless mandatory law or an applicable open-source licence allows it, you must not copy, distribute, sell, rent, sublicense, publicly provide, modify, derive, reverse engineer, decompile or disassemble PL8; extract proprietary resources; bypass a security, age, consent or access control; obtain another person's credentials; interfere with the app or service; or use PL8 unlawfully.

These restrictions do not limit a non-waivable right, lawful interoperability, lawful security research meeting its legal conditions, or a broader right granted by an open-source licence.

4. Features in the licensed release

PL8 provides a local workout log, manual food and water logging, progress views, optional Apple Health or Health Connect integration, and optional Friends access.

The licensed Germany release contains no remote AI Coach, food-photo analysis, paid offer or subscription, Expo over-the-air update, or Sign in with Apple. The licence does not promise future availability of those functions.

5. Health and user data

Health integration is optional. PL8 asks for separate explicit consent before the operating-system Health permission. You can refuse or withdraw without losing the ordinary local workout and manual food log. The Privacy Policy explains local storage, iOS automatic-backup exclusion, Android backup, withdrawal and deletion.

Uploading the three weekly fitness totals to Friends is also optional and has its own explicit consent. You can refuse or withdraw it without losing the Friends account, friendships or local workout log. Withdrawal deletes the uploaded totals and stops future uploads as described in the Privacy Policy.

PL8 is a personal logging tool, not a medical device, emergency service or substitute for qualified medical, nutritional or training advice. Check inputs and outputs before relying on them. Do not use PL8 for diagnosis, treatment or an emergency.

You are responsible for protecting device access and any portable backup you export. You must have the right to enter any information you add to PL8.

6. Stores and external services

Apple, Google, Health-platform and email-delivery services are operated by their providers under their own terms. This agreement does not grant a right to a third-party service or make Burlis responsible for that provider's independent acts.

Third-party and open-source components remain subject to their own licence terms. Where such a licence grants broader rights for its component, it governs that component. Notices are available in PL8 and at https://www.pl8.burlis.de/licences.

7. Updates, compatibility and availability

PL8 updates for this release are supplied through the applicable app store. Burlis may provide corrections, security changes and compatibility updates. An update may require a supported operating system or device. Mandatory rights to updates and digital-product conformity remain unaffected.

We do not promise that every device, operating-system version or external service will remain supported forever. Material discontinuation or a required update is communicated as required by law.

8. Ownership and feedback

Burlis and its licensors retain all rights in PL8 that are not expressly granted. No trademark or ownership right is transferred.

If you voluntarily provide feedback, Burlis may use it to improve PL8 without payment, provided this does not transfer ownership of your pre-existing material or permit use of personal data outside the Privacy Policy.

9. Maintenance, warranty and product claims

Burlis is responsible for maintenance and support required by applicable law. German statutory warranty and consumer rights apply. No additional voluntary guarantee is given unless expressly stated.

Nothing limits liability or remedies that cannot legally be limited. The liability rules in the PL8 Terms apply correspondingly to the software licence.

10. Apple App Store terms

Where PL8 is obtained through Apple's App Store, you and Burlis acknowledge:

You represent that you are not located in a country subject to a US Government embargo or designated as supporting terrorism and are not listed on a US Government prohibited or restricted-party list, to the extent this representation is required by Apple's minimum terms and lawful where you live.

This agreement must not conflict with the Apple Media Services Terms or Usage Rules. Mandatory law prevails.

11. Term and termination

The licence starts when you accept this agreement or first install or use PL8. You may end it by ceasing use and removing all copies under your control.

The licence ends if you materially breach it and fail to cure a curable breach after reasonable notice, or immediately where a serious security or unlawful use cannot reasonably be cured. Mandatory consumer notice and remedy rights remain unaffected.

After termination, stop using and remove PL8. Termination does not itself delete a Friends account, data in Apple Health or Health Connect, or a backup stored elsewhere. Use the separate deletion controls for those records.

12. Liability

Burlis has unlimited liability for intent, gross negligence, injury to life, body or health, fraudulent concealment, an expressly assumed guarantee, product liability and any other liability that cannot legally be limited.

For slight negligence, Burlis is liable for breach of an essential contractual duty only for the foreseeable damage typical for the agreement. An essential duty is one whose performance makes the agreement possible and on which you may ordinarily rely. Other liability for slight negligence is excluded to the extent permitted by law. These rules also apply to employees and agents.

13. Law, language and final terms

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. A consumer retains mandatory protection of the law of their habitual residence. No exclusive place of jurisdiction is imposed on a consumer.

For a German legal flow, the German licence agreement governs. For an English legal flow, this English version governs. Mandatory consumer protection is not limited by the language rule.

If a provision is invalid, the statutory rule applies and the remainder stays effective where legally possible. Failure to enforce a right once is not a waiver. This agreement, the Terms, applicable store terms and applicable component licences form the relevant contractual framework.
